Exemption of liability

Disclaimer

Although due care and attention has been given to this translation, it should not be considered a legal document. The original language document shall take precedence over this translation in any dispute over interpretation.

1. Content of online offering

The European Computer Telecoms Group accepts no liability for the actuality, accuracy, completeness, or quality of the information provided. Liability claims against the European Computer Telecoms Group pertaining to material or ideal damages caused by use or non-use of the provided information or use of incorrect or incomplete information are principally exempt, unless the European Computer Telecoms Group’s intentional and gravely reckless negligence can be proven.

All content is subject to confirmation and is not binding. The European Computer Telecoms Group explicitly claims the right to change, supplement, delete parts of the pages or entire pages without prior notice, or to suspend the publication temporarily or completely.

2. References and links

In case of direct or indirect references to other Web sites (“Hyperlinks”), which are outside of the European Computer Telecoms Group’s sphere of responsibility, a liability obligation only comes into effect if the European Computer Telecoms Group knew of that content and if the ECT Group been technically capable and if it had been reasonable to prevent the use of illegal content.

Hereby, the European Computer Telecoms Group explicitly declares that, at the time of link creation, no illegal content was visible on the pages to be linked. The European Computer Telecoms Group has no influence over the current or future design, content, and the copyright of the linked/associated pages. Therefore, the European Computer Telecoms Group distances itself explicitly from all content on linked/associated pages which were changed after link creation. This statement pertains to all links and references established within its own Internet offering. The provider of the site that was linked to is solely liable for illegal, incorrect or incomplete content and particularly for damages resulting from use or non-use of information provided in that manner. The party which merely refers to that publication via links is not responsible and liable.

3. Copyright and trademark law

In all of its publications, the European Computer Telecoms Group strives to respect the copyright laws of the graphics, audio documents, video sequences, and texts involved. It also strives to use self-created graphics, audio documents, video sequences, and texts, or to use graphics, audio documents, video sequences, and texts that are license-free.

All brand and trademarks named within the Internet offering and possibly protected through third parties are the unrestricted subject of regulations mandated by the trademark law and the ownership rights of the registered owner. The mere mention should not lead to the conclusion that trademarks are not protected through third-party rights.

4. Data protection

If there’s a possibility within the Internet offering to enter personal or business data (e-mail addresses, names, addresses), then the user explicitly reveals this data voluntarily. Use and payment for the provided services – if technically possible and reasonable – is permitted even without the provision of such data/along with provision of data made anonymous, or a pseudonym. Third parties are not permitted to use the contact data in the context of the imprint or comparable information – such as postal addresses, phone and fax numbers, and e-mail addresses – for purposes of distributing information not explicitly requested. Legal action taken against the sender of so-called Spam mails is explicitly reserved in case of violation of this prohibition.

5. Legal effect of this exemption of liability

The exemption of liability is to be seen as part of the Internet offering which referred to this site. If partial wordings or individual wordings in this text no longer are in line (or only partly in line or not fully in line) with the current legal position, the remaining parts of the documents remain unaffected by that in terms of their content and validity.
